国際ルールを無視した戦争の実態と、私たちが守るべきもの

2026年、世界のニュースを開けば、どこかで戦争の報告が届いてくる。爆撃された病院、逃げ惑う子どもたち、崩れ落ちるビル。遠い国の話だと感じるかもしれないが、国際ルールが崩れていくことの影響は、私たちの日常にも確実に波及してくる。
今日は、現在進行中の主な紛争における国際ルール違反の実態を整理しながら、なぜ国際法を守ることがこれほど重要なのかを考えてみたい。

国際ルールとは何か
戦争において適用されるルールには大きく2種類ある。
ひとつは「戦争をする権利」を規定するルール——つまり、いつ武力に訴えてよいか（国連憲章2条4項による武力行使禁止原則）。もうひとつは「戦争中に守るべきルール」——国際人道法は、武力紛争の危険から民間人などの非戦闘員を保護するための法律であり、紛争の全当事者は常に戦闘員と民間人を区別しなければならず、民間人が攻撃の意図的な標的になることは決してあってはならない とされている。
これらは国際社会が第二次大戦の惨禍を経て積み上げてきた、人類共通の約束事だ。

① ロシアによるウクライナ侵攻
現代における最も大規模な国際ルール違反のひとつが、2022年2月に始まったロシアのウクライナ全面侵攻だ。
【武力行使禁止原則の違反】
ロシアがウクライナの同意なくウクライナ領域内に軍隊を派遣し軍事行動を行ったことは、国連憲章第2条4項が禁じる違法な武力の行使にあたる と、日本政府も明確に位置づけている。
さらに、ロシアは2014年のクリミア軍事介入の際も、ウクライナが核不拡散条約加入にあたって締結されたブダペスト覚書——ロシアがウクライナの主権と領土保全を尊重すると約束した条約——に違反した 。つまり、国際的な取り決めを反故にする行動はそれ以前から繰り返されていた。
【民間人・民間施設への攻撃】
アムネスティ・インターナショナルは、2022年2月以来、ロシア軍がウクライナで無差別攻撃を行い、数千人の民間人が犠牲になった事例を多数確認しており、拷問や性的暴力など、その他の戦争犯罪の証拠も確認している 。
具体的には、ブチャでの多数の市民の殺害、ウクライナ各都市の住居への攻撃、人口密集地でのクラスター爆弾の使用、子ども12万人以上の強制的なロシア領内への連れ去り、マリウポリにおける産科病院や劇場への空爆などが、国際刑事裁判所（ICC）規程が定める戦争犯罪に該当する とされている。
【原子力発電所への攻撃】
ウクライナに侵攻したロシア軍の戦闘行為に「国際法違反」との批判が相次ぎ、原子力発電所への攻撃や病院への爆撃、大量破壊兵器の使用が指摘されている 。原発への攻撃は、周辺住民のみならず国境を越えた放射線被害をもたらしかねない、きわめて危険な行為だ。

② ガザ紛争（イスラエル・パレスチナ）
2023年10月7日のハマスによるイスラエルへの無差別攻撃を発端に、ガザでの大規模な軍事衝突が続いている。この紛争でも、双方に対して深刻な国際法違反の指摘がある。
【民間インフラへの攻撃と比例性原則】
アムネスティ・インターナショナルは、エネルギーインフラへの攻撃が「広範囲かつ予測可能で壊滅的な民間人被害」をもたらす可能性があることは、こうした攻撃が「国際人道法に違反する重大なリスクを伴う」ことを意味すると述べている 。
ガザでは病院、学校、住宅密集地が繰り返し攻撃され、人道支援の通路を遮断する「封鎖」も食料・医薬品の不足という深刻な人道危機を引き起こしている。

③ 混迷するスーダン内戦
あまり日本のメディアでは取り上げられないが、アフリカでは複数の国で内戦が起きており、エチオピア、マリ、スーダンなどでの武力紛争が人命を危機にさらし続けている 。
スーダンでは2023年から国軍と準軍事組織RSFの間で内戦が勃発し、民間人への大規模な暴力、強制退去、性的暴力が報告されている。国際社会の監視が行き届きにくい紛争地帯ほど、人道法の遵守が疎かになりやすいという現実がある。

国際ルールが守られないとどうなるのか
では、国際ルールが破られ続けた場合、世界はどうなるのだろうか。
第一に、「力による支配」が正当化される世界になる。
第二次世界大戦後に構築された国際秩序は、冷戦終結後も比較的安定して存続してきたが、2020年代に入りその基盤が揺らいでいる。この変化は、国際法・規範への挑戦やパワーバランスの変動によって顕在化している 。強い国がルールを無視して弱い国を攻撃しても「罰せられない」という前例が積み重なると、世界のあらゆる場所で同様の行動が誘発される。
第二に、普通の市民が最大の被害者になる。
戦時国際法には強制力がないため、もし違反する国があっても国際的に罰することができない 。しかし罰せられないことと許されることは別だ。ルールなき戦場で死んでいくのは、兵士だけではない。子ども、医師、学校の先生、農家——何の罪もない市民が犠牲になる。
第三に、日本も無関係ではいられない。
2026年の国際情勢は、既存の国際秩序の揺らぎ、地域紛争の連鎖的悪化、情報・経済の不確実性という複数のリスク要因が複雑に絡み合っており、政策立案者は短期的な安全保障対応だけでなく、国際協調の再構築と新たなルール形成を優先する必要がある 。東アジアにも緊張の火種は存在する。どこかの地域でルール無視が「成功」すれば、それは別の地域の挑発を呼び込む連鎖になりかねない。

国際ルールを守ることの本質的な意味
自由権規約は「すべての人間は、生命に対する固有の権利を有する」と定めており、生命権を脅かされている人々にとっての一縷の望みは、国際人権法の考えに裏打ちされた国際法の存在それ自体だ と、人権の専門家は述べている。
国際ルールとは、単なる外交上の「お作法」ではない。それは人類が幾度もの悲惨な戦争を経験した末に、「二度と同じ過ちを繰り返すまい」という痛みの中から生み出した、生命と尊厳を守るための最後の盾なのだ。
国際法上の犯罪を行った者はすべて、公正な裁判手続きで裁かれなければならず、被害者は救済されなければならない という原則が機能しなくなったとき、世界は暴力と恐怖が支配する場所に逆戻りしてしまう。

私たちにできること
遠い国の戦争を前に、無力感を覚える人も多いだろう。しかし知ること、伝えること、そして声を上げることは、確かに意味を持つ。
国際ルールを守らせる力は、最終的には「世界中の人々がそれを当然のこととして要求し続ける」という、市民社会の総意の積み重ねから生まれる。ニュースを見て、考え、語り合う——その一歩が、遠い誰かの命を守ることにつながっていると、私は信じている。

In 2026, open any news feed and somewhere, a report of war arrives. Bombed hospitals. Children fleeing in panic. Buildings crumbling to dust. It may feel like something happening in a distant land — but when international rules begin to collapse, the consequences reach all of us.
Today, I want to look at the reality of international law violations in some of the world’s ongoing conflicts, and explore why respecting international law matters so deeply.

What Are International Rules?
There are two broad categories of rules that apply to war.
The first governs the right to wage war — that is, when a state may resort to force (enshrined in Article 2(4) of the UN Charter, which prohibits the use of force). The second governs how war must be conducted. International humanitarian law exists to protect civilians and other non-combatants from the dangers of armed conflict. It applies to all parties in a conflict, and requires that combatants always distinguish between fighters and civilians — civilians must never be the deliberate target of attack.
These are not abstract ideals. They are the promises humanity made to itself after the devastation of the Second World War.

① Russia’s Invasion of Ukraine
One of the most significant violations of international rules in modern times began in February 2022, when Russia launched its full-scale invasion of Ukraine.
Violation of the Prohibition on the Use of Force
Russia’s deployment of military forces into Ukrainian territory without Ukraine’s consent constitutes an illegal use of force prohibited under Article 2(4) of the UN Charter — a position clearly stated by the Japanese government.
Even earlier, Russia’s 2014 military intervention in Crimea violated the Budapest Memorandum — a treaty in which Russia had pledged to respect Ukraine’s sovereignty and territorial integrity in connection with Ukraine’s accession to the Nuclear Non-Proliferation Treaty. The pattern of disregarding international commitments did not begin in 2022.
Attacks on Civilians and Civilian Infrastructure
Amnesty International has documented numerous cases since February 2022 in which Russian forces carried out indiscriminate attacks in Ukraine, killing thousands of civilians, with evidence of torture and sexual violence also confirmed.
More specifically, the killings of civilians in Bucha, attacks on residential buildings across Ukrainian cities, the use of cluster munitions in densely populated areas, the forcible transfer of more than 120,000 children to Russian territory, and airstrikes on a maternity hospital and a theater in Mariupol have all been identified as war crimes under the Rome Statute of the International Criminal Court.
Attacks on Nuclear Power Plants
Widespread criticism of Russia’s military conduct has followed, including attacks on nuclear power plants, the bombing of hospitals, and the alleged use of weapons of mass destruction — all pointed to as violations of international law. Attacking a nuclear facility risks radiation exposure not just for local populations, but across borders.

② The Gaza Conflict (Israel and Palestine)
Sparked by Hamas’s indiscriminate attack on Israel on October 7, 2023, large-scale military operations in Gaza have continued. In this conflict too, serious allegations of international law violations have been raised against multiple parties.
Attacks on Civilian Infrastructure and the Principle of Proportionality
Amnesty International has stated that attacks on energy infrastructure, given their “widespread, predictable, and catastrophic civilian impact,” carry “a serious risk of violating international humanitarian law.”
In Gaza, hospitals, schools, and densely populated residential areas have been repeatedly struck. Blockades cutting off humanitarian corridors have triggered a severe humanitarian crisis, with shortages of food and medicine affecting the civilian population.

③ The Forgotten War: Sudan’s Civil War
Rarely covered in Japanese media, internal conflicts in several African countries — including Ethiopia, Mali, and Sudan — continue to endanger lives and warrant the attention of the international community.
Since civil war erupted in Sudan in 2023 between the national army and the paramilitary RSF, widespread violence against civilians, mass displacement, and sexual violence have been reported. The harder a conflict is for the international community to monitor, the more likely humanitarian law is to be ignored.

What Happens When International Rules Are Broken?
So what kind of world emerges when international rules are repeatedly violated?
First, “might makes right” becomes the norm.
The international order built after World War II remained relatively stable even after the Cold War, but its foundations have been shaking since the 2020s — driven by challenges to international law and norms, and by shifting balances of power. When powerful states violate rules and face no real consequence, it sets a precedent that invites similar behavior elsewhere.
Second, ordinary civilians pay the highest price.
Because international humanitarian law lacks enforcement mechanisms, there is no way for the international community to punish a state that violates it. But the absence of punishment is not the same as permission. Those who die on a lawless battlefield are not only soldiers — they are children, doctors, teachers, farmers. People who did nothing wrong.
Third, Japan is not immune.
The international situation in 2026 involves multiple overlapping risks — the erosion of existing international order, the cascading deterioration of regional conflicts, and economic and informational uncertainty. Policymakers need to prioritize not just short-term security responses, but the rebuilding of international cooperation and the formation of new rules. East Asia, too, carries its own tensions. When rule-breaking “succeeds” in one region, it emboldens provocation in another.

The Deeper Meaning of Respecting International Law
The International Covenant on Civil and Political Rights states that “every human being has the inherent right to life,” and for those whose right to life is under threat, the very existence of international law — grounded in international human rights — is their last hope.
International rules are not mere diplomatic formalities. They are the final shield protecting life and dignity — forged from humanity’s most painful lessons, from the ashes of wars we vowed never to repeat.
All those who commit crimes under international law must be brought to justice through fair proceedings, and victims must receive redress. When that principle stops functioning, the world slides back toward a place governed by violence and fear.

What Can We Do?
Faced with distant wars, many people feel powerless. But knowing, sharing, and speaking up genuinely matters.
The force that compels states to respect international rules ultimately comes from the collective insistence of people around the world — the accumulated weight of citizens who regard these norms as non-negotiable. Reading the news, thinking critically, talking with others — that first step connects, in ways we may not see, to the protection of someone’s life, far away.
